Information On Workers’ Comp Benefits

Workers’ compensation is an insurance that provides cash benefits and/or medical care for workers who have been injured during the course of their work or suffered an occupational illness or disease.

The New York State Workers’ Compensation Board is the state agency that processes claims, and weekly cash benefits and medical care are paid by the employer’s insurance carrier, under the direction of the Workers’ Compensation Board.

Workers’ compensation benefits include:

  • Cash benefits: Cash benefits are 2/3 x average weekly wage x % of disability = weekly benefit.
  • Supplemental benefits: These are for claimants/beneficiaries who are classified as permanently disabled by an injury that occurred prior to January 1, 1979, and widows or widowers receiving death benefits as a result of the death of a spouse that occurred prior to January 1, 1979.
  • Medical benefits: For necessary medical care related to the original injury or illness and the recovery from his or her disability.
  • Social Security benefits: For workers who become seriously disabled for a continuous period of at least 12 months, or permanently, they may be entitled to monthly Social Security benefits.
  • Death benefits: For workers who die from a compensable injury, a surviving spouse and/or minor children or other dependents as defined by law may be entitled to death benefits.
